We receive frequent phone calls about whether we will “fix” a ticket.
Unfortunately, it is the prosecutor’s policy that he will not do this. However, if you have received a ticket which is being prosecuted in City Court, you may contact this office to request consideration of your ticket for a plea agreement.
You should consult an attorney.
However, if you are not going to hire counsel, and you would like your ticket or tickets to be considered
for a plea agreement, you need to contact this office as soon as possible, and certainly prior to
your scheduled court date.
If you send your request in writing, you need to provide a copy of your ticket, a copy of your driving record, and you may also include a brief explanation of the facts as you see them, although the explanation is not required. If your case qualifies for a plea agreement, an offer letter will be sent to you.
If you have not complied with ALL of the terms of your offer letter, or if you have not received an offer letter, you MUST appear in court on the date shown on your ticket. If you do not appear, a warrant may well be issued for your arrest, and the court may assess an additional fine for your failure to appear.
A plea agreement is not a right, and is entirely at the prosecutor’s discretion.
A plea agreement is an agreement between you and the prosecutor that he would recommend a particular sentence to the judge, and you would plead guilty to the charge based on that recommendation. The judge is not bound to accept such an agreement and determines the final sentence in the event a person pleads guilty. However, upon good cause shown, a Judge generally does accept such plea agreements.
